In the U.S. regulatory systems from both find their roots in the Interstate Commerce Act and underlying economic assumptions.  Where I see we are trapped in maladaptive regulatory systems, particularly with regard to communications, is that in the cultural conversation that too place between law and technology, we over-focused on the "cost" of building these systems rather than promoting the value of adaptive interconnectivity.  I'll write about this more in subsequent posts.
